Amputation Injuries Happen in Many Kinds of Florida Crashes<\/h2>\n

Florida’s roads, construction sites, and waterways are shared by commuters, truck drivers, riders, workers, and families.<\/p>\n

A serious crash in Miami, Orlando, Tampa, Jacksonville, Fort Lauderdale, West Palm Beach, or elsewhere in the state can cause limb loss. The cause may differ from case to case.<\/p>\n

How Amputation Injuries Occur<\/h2>\n

Truck crashes.<\/strong> A collision with a large commercial truck can crush or trap a limb inside or under a vehicle. These vehicles are large and heavy. The force of impact may be severe.<\/p>\n

Motorcycle and ATV accidents.<\/strong> Riders are not enclosed in a vehicle body. In a crash, a limb may hit the pavement, another vehicle, a guardrail, or a fixed object.<\/p>\n

Types of Catastrophic Injuries That Can Accompany Amputation<\/h2>\n

Amputation is often one of several serious injuries in a crash. Other injuries may include the following.<\/p>\n

Spinal cord injuries<\/a> and paralysis<\/a>.<\/strong> High-impact collisions can damage the spine. A person may have paraplegia<\/a> (paralysis of the lower body). A person may also have quadriplegia (paralysis of all four limbs). Outcomes vary by person and depend on medical care.<\/p>\n

Traumatic brain injuries (TBI).<\/strong> Head trauma can cause memory loss and changes in thinking and personality. It can also cause long-term disability. Outcomes vary by person.<\/p>\n

Severe burn injuries.<\/strong> Burns may occur when fuel ignites. They may also occur when a person touches a hot engine. Severe burns may require long hospital stays, skin grafts, and ongoing wound care.<\/p>\n

Catastrophic back and neck injuries.<\/strong> These can cause chronic pain, loss of function, and permanent impairment. This can happen even without complete paralysis.<\/p>\n

Drowning and near-drowning.<\/strong> A near-drowning can cause lasting neurological injury. That injury can lead to serious cognitive and physical harm.<\/p>\n

Wrongful death.<\/strong> When a crash causes a death, the family may face funeral and burial expenses. They may lose financial support. They also lose a loved one. Families who lose a loved one in an accident or act of wrongdoing often have questions about wrongful death claims. Each situation is different, and the details of an individual’s circumstances shape which options may be available.<\/p>\n

Who May Be Responsible<\/h2>\n

Responsibility depends on how the crash happened. More than one party may share responsibility.<\/p>\n

Truck crashes.<\/strong> A driver, a trucking company, or another party may be responsible. This depends on the facts.<\/p>\n

In a 2026 U.S. Supreme Court decision, Montgomery v. Caribe Transport II, LLC<\/em><\/a>, the Court addressed a state-law claim. The claim says a broker negligently hired an unsafe motor carrier. The Court found that the claim falls within the FAAAA’s safety exception.<\/p>\n

In plain terms, that exception keeps the claim from being blocked by federal preemption. Federal preemption is a legal concept that may come into play when federal and state law conflict. Whether it applies in a particular case depends on the specific laws and facts involved. Whether that reasoning applies to a particular case depends on its facts.<\/p>\n

Watercraft operators.<\/strong> Florida law provides that operators of vessels must exercise “the highest degree of care in order to prevent injuries to others.” See Fla. Stat. \u00a7 327.32<\/a>.<\/p>\n

Vessel owners.<\/strong> Under Fla. Stat. \u00a7 327.32<\/a>, liability for reckless or careless operation is generally limited to the operator in immediate charge of the vessel. It is generally not imposed on the owner. The exception is when the owner is the operator or is present in the vessel when the injury occurs. Other facts may still matter.<\/p>\n
