Driver logs and dispatch messages are kept for only a short time. A wrecked truck can be repaired, sold, or scrapped. Once that proof is gone, you usually can&#8217;t get it back.<\/p>\n<p>That is why the best move after a serious truck crash is often the fastest one. Someone must send a <strong>letter of preservation<\/strong> (also called a spoliation letter). It tells the trucking company (and its insurer) to keep all evidence from the crash. They must not change, repair, or destroy anything.<\/p>\n<p>Once a company gets this letter, destroying evidence can cause legal trouble. A court can tell a jury to assume the missing evidence would have hurt the company. This penalty is called a <em>spoliation<\/em> sanction. That is where the letter gets its nickname.<\/p>\n<p>Why the rush? Federal rules only require companies to keep some records for a short time:<\/p>\n<ul>\n<li><strong>Driver hours-of-service logs (ELD records):<\/strong> trucking companies must keep supporting documents for <strong>six months<\/strong> under <a href=\"https:\/\/www.ecfr.gov\/current\/title-49\/subtitle-B\/chapter-III\/subchapter-B\/part-395\">49 C.F.R. \u00a7395.8<\/a>.<\/li>\n<li><strong>Driver Vehicle Inspection Reports:<\/strong> kept for <strong>three months<\/strong> under <a href=\"https:\/\/www.ecfr.gov\/current\/title-49\/subtitle-B\/chapter-III\/subchapter-B\/part-396\">49 C.F.R. \u00a7396.11<\/a>.<\/li>\n<li><strong>Onboard crash data (the &#8220;black box&#8221;):<\/strong> not on any legal schedule. It can be recorded over the next time the truck runs enough miles.<\/li>\n<\/ul>\n<p>A preservation letter freezes all of this before the time runs out. About <strong>5.4 million<\/strong> Americans live with some form of paralysis, per the <a href=\"https:\/\/www.christopherreeve.org\/todays-care\/living-with-paralysis\/stats-about-paralysis\/\">Christopher &amp; Dana Reeve Foundation<\/a>.<\/p>\n<p>When the harm lasts for decades, proving what happened protects the money a family will need. That money must cover decades of care.<\/p>\n<p>Trucks also create evidence that regular cars don&#8217;t. This includes electronic recorders, federal logs, and company files. Several parties may share the blame too \u2014 the driver, the trucking company, the cargo loader, or a maintenance contractor. Finding all of it is a big job. This is required by <a href=\"https:\/\/www.ecfr.gov\/current\/title-49\/subtitle-B\/chapter-III\/subchapter-B\/part-395\">49 C.F.R. Part 395<\/a> to record driving time.<\/p>\n<p>Federal hours-of-service rules from the <a href=\"https:\/\/www.fmcsa.dot.gov\/regulations\/hours-of-service\">Federal Motor Carrier Safety Administration (FMCSA)<\/a> limit most truck drivers. They can drive <strong>11 hours<\/strong> after 10 hours off duty, within a <strong>14-hour<\/strong> work window. ELD data is key to proving fatigue and rule violations.<\/p>\n<p>Other electronic data can help too:<\/p>\n<ul>\n<li>In-cab and dash camera video.<\/li>\n<li>GPS and telematics showing routes and speeds.<\/li>\n<li>Records from collision-avoidance and automatic-braking systems.<\/li>\n<\/ul>\n<p>The catch: much of this can be recorded over on the next trip. That is exactly why the preservation letter goes out first.<\/p>\n<h2>Trucking company and driver records<\/h2>\n<p>Company and driver files often show the deeper cause of a crash. They reveal whether the company hired, trained, watched over, and maintained safely:<\/p>\n<ul>\n<li><strong>Driver logs and hours-of-service records.<\/strong> Fatigue is a leading cause of severe truck crashes.<\/li>\n<li><strong>The driver qualification file<\/strong> (<a href=\"https:\/\/www.ecfr.gov\/current\/title-49\/subtitle-B\/chapter-III\/subchapter-B\/part-391\">49 C.F.R. \u00a7391.51<\/a>) \u2014 training, license history, and past violations.<\/li>\n<li><strong>Post-crash drug and alcohol testing,<\/strong> required after certain serious crashes under <a href=\"https:\/\/www.ecfr.gov\/current\/title-49\/subtitle-B\/chapter-III\/subchapter-B\/part-382\">49 C.F.R. \u00a7382.303<\/a>.<\/li>\n<li><strong>Maintenance and inspection records,<\/strong> which can show neglected brakes, worn tires, or other defects.<\/li>\n<li><strong>Cargo and weight documents.<\/strong> A <strong>bill of lading<\/strong> shows what the truck carried. An overloaded or badly loaded truck can lose control.<\/li>\n<\/ul>\n<p>You usually can&#8217;t ask for most of these files on your own. A lawyer can demand them. This can point to distracted driving.<\/p>\n<p>Dispatch logs and messages can reveal something else. They may show pressure to drive faster or longer than the law allows. Internal emails sometimes show a company knew about a safety problem and ignored it. This kind of proof connects the crash to company choices, not just one driver&#8217;s mistake.<\/p>\n<h2>Insurance policies and the parties who may be responsible<\/h2>\n<p>The driver isn&#8217;t always the only one at fault. Others may share blame:<\/p>\n<ul>\n<li>The trucking company.<\/li>\n<li>A maintenance contractor.<\/li>\n<li>A cargo-loading company.<\/li>\n<li>A truck or parts manufacturer.<\/li>\n<\/ul>\n<p>Each may carry its own insurance.
