Together they hold a person or company legally responsible for hurting you. If even one is missing, the claim usually fails.<\/p>\n<p>You may see these called &#8220;elements&#8221; or &#8220;criteria.&#8221; Some sources list <strong>five<\/strong> elements instead of four. There is no real disagreement. The five-element version just splits <strong>causation<\/strong> into two parts: actual cause and proximate cause. Cornell Law School&#8217;s Legal Information Institute defines negligence using duty, breach, causation, and harm. It explains that causation has both a &#8220;cause in fact&#8221; part and a &#8220;proximate cause&#8221; part (<a href=\"https:\/\/www.law.cornell.edu\/wex\/negligence\">Cornell LII<\/a>). It depends on the relationship and the situation.<\/p>\n<p><strong>Our truck-crash example.<\/strong> A commercial truck driver owes everyone on the road a duty to drive safely. The trucking company owes the public a duty to follow federal safety rules. For example, there are limits on how many hours a driver can drive. These are the driving-hour limits in the Federal Motor Carrier Safety Regulations. They generally cap a property-carrying driver at 11 hours of driving after 10 hours off duty (<a href=\"https:\/\/www.ecfr.gov\/current\/title-49\/subtitle-B\/chapter-III\/subchapter-B\/part-395\">49 C.F.R. \u00a7395.3<\/a>). The company must also inspect and maintain its vehicles.<\/p>\n<p><strong>Our unsafe-property example.<\/strong> Say you were attacked, robbed, or shot on someone else&#8217;s property. Maybe it was an apartment complex, a parking garage, a hotel, a bar, a gas station, or a store. A business or landlord invites people onto its property. So it has a duty to take reasonable steps to keep them reasonably safe. That can mean working locks and gates, good lighting, cameras, or security guards when the risk calls for it.<\/p>\n<p>Lawyers call this type of case <strong>inadequate security<\/strong> or <strong>negligent security<\/strong>. You do not need to know that term to have a claim. What matters is simple: a property owner failed to protect you, and you were seriously hurt because of it.<\/p>\n<h2>Requirement 2 \u2014 Breach of duty: they failed to meet the standard of care<\/h2>\n<p><strong>A breach means someone fell short of what a reasonably careful person or business would have done<\/strong> in the same situation. It is not about being perfect. It is about failing to act reasonably.<\/p>\n<p>Back to our two examples:<\/p>\n<ul>\n<li><strong>Truck crash:<\/strong> the company skips required maintenance. Or the driver fakes hours-of-service logs, speeds, drives tired, or drives distracted.<\/li>\n<li><strong>Unsafe property:<\/strong> the owner ignores a broken gate or dead lights. Or the owner cuts cameras and security staff <em>after<\/em> violent crime has already happened on or near the property.<\/li>\n<\/ul>\n<p>That last point matters. An owner may know about past violence and still do nothing. That failure can be a clear breach.<\/p>\n<h2>Requirement 3 \u2014 Causation: the breach actually caused your injury<\/h2>\n<p><strong>Causation means the breach \u2014 not some unrelated event \u2014 actually caused your injury.<\/strong> Many other pages skip past this. But it is really <em>two<\/em> questions. You usually have to answer both.<\/p>\n<p><strong>Part one \u2014 actual cause<\/strong> (also called &#8220;but-for&#8221; or &#8220;cause in fact&#8221;). Ask this: <em>but for<\/em> the failure, would you still have been hurt? In our property example, suppose working locks and lighting would have stopped the attack. Then the missing security is an actual cause.<\/p>\n<p><strong>Part two \u2014 proximate cause.<\/strong> This part is about foreseeability. Was your harm a foreseeable result of the failure? Cornell LII confirms a plaintiff must show both cause in fact and proximate cause (<a href=\"https:\/\/www.law.cornell.edu\/wex\/negligence\">Cornell LII<\/a>). Picture a garage with past robberies, no cameras, and no lighting. That makes a later attack foreseeable. So the harm is not some freak, disconnected event. It is exactly the kind of thing reasonable security exists to prevent.<\/p>\n<p>Both parts have to connect. A breach that had nothing to do with your injury fails on actual cause. An injury too strange to blame on the breach fails on proximate cause. Neither will support a claim.<\/p>\n<p>Causation is often the most fought-over element. The other side may argue that something else caused your injury. That is exactly why saving evidence early matters so much (more on that below).<\/p>\n<h2>Requirement 4 \u2014 Damages: you suffered real, measurable harm<\/h2>\n<p><strong>Damages mean you suffered actual, legally recognized harm \u2014 injuries, medical bills, lost income, and permanent loss.<\/strong> Without damages, there is usually no claim to bring. So, can you sue for negligence if you were not injured? Usually no. A careless act with no real harm is generally not enough.<\/p>\n<p>Our firm focuses on catastrophic, life-altering injuries. The garage has broken gates, no lighting, and past reports of violent crime. One night, the resident is attacked and suffers a traumatic brain injury.<\/p>\n<ul>\n<li><strong>Duty:<\/strong> the owner owed a duty to take reasonable steps to keep residents and visitors reasonably safe.<\/li>\n<li><strong>Breach:<\/strong> the owner ignored the broken gates, the darkness, and the known crime history.<\/li>\n<li><strong>Causation (both parts):<\/strong> <em>but for<\/em> the missing security, the attack likely would not have happened (actual cause). And given the past crime, an attack was foreseeable (proximate cause).<\/li>\n<li><strong>Damages:<\/strong> a life-altering brain injury with lasting medical and money costs.<\/li>\n<\/ul>\n<p>In a civil case, you do not have to prove anything &#8220;beyond a reasonable doubt.&#8221; That is the criminal standard. The civil standard is <strong>preponderance of the evidence<\/strong>. That means more likely than not. The injured person (the plaintiff) generally carries that burden.<\/p>\n<h2>Evidence used to prove the four requirements<\/h2>\n<p><strong>Strong cases are built on evidence that ties the breach to your injuries.<\/strong> Common types include:<\/p>\n<ul>\n<li>Incident reports and police reports<\/li>\n<li>Medical records that document your injuries<\/li>\n<li>Photos and video of the scene and conditions<\/li>\n<li>Security-camera footage<\/li>\n<li>A property&#8217;s past-crime history (police calls-for-service records can help show it)<\/li>\n<li>For truck cases: the driver&#8217;s logs, the truck&#8217;s inspection and maintenance records, and electronic control module (&#8220;black box&#8221;) data<\/li>\n<li>Witness statements and expert testimony<\/li>\n<\/ul>\n<p>Saving evidence early is critical. Security footage is often erased within days or weeks. Broken locks get fixed and lights get repaired. Trucking companies only have to keep certain records for limited periods. Once proof is gone, it&#8217;s gone.
