Why you may have two separate claims<\/h2>\n<p>This is the point that confuses people most. So we&#8217;ll be precise.<\/p>\n<p>Say a defective machine amputated your hand on the job. You generally have <strong>two separate claims running on separate tracks:<\/strong><\/p>\n<ol>\n<li><strong>Workers&#8217; compensation<\/strong> \u2014 a no-fault system through your employer&#8217;s insurer. &#8220;No-fault&#8221; means it pays no matter who caused the injury. It covers medical bills and part of your lost wages. But it does <em>not<\/em> pay for pain and suffering. And you usually can&#8217;t sue your employer directly.<\/li>\n<li><strong>A third-party product-liability claim<\/strong> \u2014 a separate lawsuit against the company that <em>made or sold the machine<\/em> (not your employer). Because it targets a different company, workers&#8217; comp does not block it. In Florida, your workers&#8217; comp insurer may have paid your benefits. If so, it may claim a right to be repaid out of a third-party recovery. Responsibility can reach the manufacturer, the maker of a part, the distributor, and the retailer. Stat. \u00a7768.81<\/a> \u2014 as changed in March 2023 \u2014 a person found <strong>more than 50% at fault<\/strong> for their own injury generally recovers nothing.
