First, someone else&#8217;s negligence (their carelessness) caused the injury. Second, that injury ended your loved one&#8217;s life.<\/p>\n<p>The death can come at the scene or in the hospital. It can also come weeks, months, or years later, when a complication traces back to the original injury. Families are often surprised by this.<\/p>\n<p>We are not talking about routine injuries. We mean <a href=\"\/resources\/glossary\/paralysis\/\">paralysis<\/a> (<a href=\"\/resources\/glossary\/paraplegia\/\">paraplegia<\/a> or quadriplegia), a broken neck, or spinal cord damage that changed everything. The NSCISC is the federally funded body that has tracked spinal cord injury data in the U.S. for decades.<\/li>\n<li><strong>Blood clots<\/strong> (deep vein thrombosis, pulmonary embolism) caused by reduced movement<\/li>\n<li><strong>Sepsis<\/strong> (an infection that spreads through the body) and infections from lying still for long periods<\/li>\n<\/ul>\n<p>Here is the point families most often miss. A death months or years after a crash or attack can still be legally connected to it. In catastrophic cases, a careful medical review can link a later death to the injury that started it. That review studies the medical records and, in some cases, an autopsy. That link is often what a claim turns on. The injured person fights to recover. The case becomes a wrongful death claim if the injury later takes their life, and the focus shifts to what the family and the estate now carry. The action is brought by the decedent&#8217;s personal representative, who recovers for the survivors and the estate (<a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0768\/Sections\/0768.20.html\">\u00a7 768.20<\/a>). Any recovery is meant for the surviving family and the estate.<\/p>\n<p>Do not assume you have no right to file. Eligibility rules surprise people all the time. A property owner must keep the property reasonably safe.<\/li>\n<li>The driver was fatigued or speeding. Your family member was shot, robbed, or assaulted in an apartment complex, a parking garage, a hotel or motel, a bar, a gas station, a store, or near an ATM. The attack happened in a place where the owner had not provided reasonable security: working locks and gates, lighting, cameras, or guards that a reasonable owner would have had in place.<\/p>\n<p>When an unsafe property lets a foreseeable crime happen, the property owner may share responsibility for the harm. Medical negligence cases have their own deadline rules, discussed below.<\/p>\n<p>Fatal traffic crashes are tracked in the United States through the Fatality Analysis Reporting System (FARS), run by the National Highway Traffic Safety Administration (<a href=\"https:\/\/www.nhtsa.gov\/research-data\/fatality-analysis-reporting-system-fars\">NHTSA<\/a>). Behind every entry in that dataset is a family like yours.<\/p>\n<h2>Court approval of settlements and protections for children<\/h2>\n<p>Many families first hear the word &#8220;settlement&#8221; at a difficult moment, and it can be frightening. Florida law includes safeguards designed for families in exactly this position.<\/p>\n<p>While a wrongful death action is pending, no settlement as to amount or apportionment among the beneficiaries that a survivor objects to, or that affects a survivor who is a minor or an incompetent, is effective unless the court approves it (<a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0768\/Sections\/0768.25.html\">\u00a7 768.25<\/a>). That is the court&#8217;s role: to look at the terms that affect survivors, including minor children.<\/p>\n<p>The law also requires the court to protect any amount awarded for the benefit of a minor child or an incompetent person under the Florida Guardianship Law (<a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0768\/Sections\/0768.23.html\">\u00a7 768.23<\/a>). For a family with children, this means the money meant for a child is not simply handed over without oversight.<\/p>\n<h2>What compensation may cover<\/h2>\n<p>Every case is different, and no lawyer can promise an amount. Florida&#8217;s wrongful death damages are set out in <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0768\/Sections\/0768.21.html\">\u00a7 768.21<\/a>. In general, the law sorts recovery into the following kinds:<\/p>\n<ul>\n<li><strong>Losses of support and services.<\/strong> Each survivor may recover the value of lost support and services, past and future, measured from the date of injury and the date of death.<\/li>\n<li><strong>Companionship and guidance.<\/strong> A surviving spouse may recover for the loss of the decedent&#8217;s companionship and protection, and minor children may recover for lost parental companionship, instruction, and guidance. Both may recover for mental pain and suffering from the date of injury.<\/li>\n<li><strong>Parents of a deceased minor child<\/strong> may recover for mental pain and suffering from the date of injury, and parents of an adult child may also recover for mental pain and suffering if there are no other survivors.<\/li>\n<li><strong>Medical and funeral expenses<\/strong> may be recovered by a survivor who has paid them, and the decedent&#8217;s personal representative may recover certain expenses for the estate.<\/li>\n<\/ul>\n<p>Medical negligence claims have a special rule. Under <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799\/0768\/Sections\/0768.81.html\">\u00a7 768.81<\/a>, contributory fault chargeable to the injured person reduces the damages awarded for the injury attributable to that fault but does not, by itself, bar recovery. The statute also provides that any party found greater than 50 percent at fault for their own harm may not recover any damages. This subsection does not apply to an action for damages for personal injury or wrongful death arising out of medical negligence pursuant to chapter 766.<\/p>\n<p>Because insurers and defendants often argue that the victim contributed to the accident, families should not assume that a fault argument ends their claim. Ask us how this rule would be applied to the facts of your loss.<\/p>\n<h2>Deadlines, and why evidence disappears<\/h2>\n<p>Wrongful death claims have strict deadlines. Missing one can permanently end a claim.<\/p>\n<p>In Florida, filing deadlines are set by <a href=\"https:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0000-0099\/0095\/Sections\/0095.11.html\">Fla. Stat. \u00a795.11<\/a>, and the period depends on the type of claim. For example, that statute sets a two-year period for medical malpractice actions, counted from when the incident occurred or was discovered, with an outer limit of 4 years, except that this 4-year period does not bar an action brought on behalf of a minor on or before the child&#8217;s eighth birthday, and where fraud, concealment, or intentional misrepresentation prevented discovery, the period is extended forward 2 years from when the injury is discovered or should have been discovered, but in no event to exceed 7 years from the date the incident occurred. The statute also provides a separate period for an action for wrongful death. Deadlines apply to every type of case, so do not wait.<\/p>\n<p>Evidence has its own clock. Surveillance footage is often overwritten within days or weeks. A truck&#8217;s electronic control module data can be lost. A property owner may quietly repair a broken gate or add the lighting that was missing. Acting early preserves proof.
