It does not depend on an average.

Some websites post an “average settlement” for paralysis. Others ask you to enter numbers into a calculator. Be skeptical of both.

Those figures describe someone else’s case. Often, they exist to collect your contact information.

This page explains the real factors that shape the value of a catastrophic spinal, back, neck, or brain injury claim in Florida. It also explains why a permanent injury changes the entire analysis.

Why an Average Payout for Paralysis Can Mislead

No reliable “average” exists for a catastrophic injury. Publishing one would mislead you.

Averages mix cases that have nothing in common. A number that combines a C5 quadriplegia case with a partly healed back strain tells you nothing about either one. Catastrophic injuries are a category apart. Their losses do not belong in the same math.

Calculators cannot see your life. An online tool does not know your age, your work history, or your insurance. It also does not know how many hours of home care your doctor expects you will need over the coming decades. These facts change the value of a case.

Most of the loss has not happened yet. In a permanent-injury case, the largest share of the loss is future. It includes years of medical care, equipment, and lost income. No generic chart can project that.

Permanent injuries, such as spinal cord damage, paraplegia, and quadriplegia, are why simple formulas fail.

The Clinical Reality: Complete vs. Incomplete Injury and Why Permanence Drives Value

Valuation starts with the injury as your doctors describe it. The medical findings set the limit on lifetime cost. Hope about the outcome does not.

Doctors classify spinal cord injuries using the ASIA Impairment Scale (AIS). The American Spinal Injury Association developed this scale. It is part of the International Standards for Neurological Classification of Spinal Cord Injury (ISNCSCI). The scale grades injuries from A to E:

AIS A (complete): No motor or sensory function is kept in the lowest sacral segments (S4–S5). This is a complete injury. It means total loss of movement and sensation below the level of damage.

AIS B, C, and D (incomplete): Some sensory or motor function remains below the injury level. C and D mean the muscles have usable, and sometimes functional, strength.

AIS E: Normal function.

Two other terms matter for value.

The first is the level of injury. Cervical injuries that affect the arms and legs cause tetraplegia, also called quadriplegia. Thoracic or lumbar injuries usually affect the trunk and legs. That is called paraplegia.

The second is whether the loss is permanent. A complete cervical injury generally means the highest lifetime care burden. An incomplete lower injury may follow a different path. It can still be catastrophic.

A permanent injury replaces weeks of recovery with a lifetime of consequences. The Mayo Clinic notes that spinal cord injury can cause lasting problems. These include:

bladder and bowel dysfunction,

muscle loss,

blood-pressure and circulation problems,

pressure sores, and

trouble breathing.

Each problem has its own care costs, year after year. A serious valuation accounts for that. A calculator does not.

Economic Damages: The Costs You Can Count and Prove

Economic damages are measurable dollar losses. They are shown with bills, records, and professional projections. In a catastrophic case, they can be very large. They cover an entire life.

They commonly include:

Past and future medical care: surgery, hospital stays, rehabilitation, and lifelong care from doctors and other medical providers.

Long-term and attendant care: home health aides, skilled nursing, or assisted living. This care is often measured in daily hours.

Lost wages and lost earning capacity: This is often one of the largest parts of a claim. It applies when a person can no longer work as before.

Home and vehicle modifications: wheelchair ramps, wider doorways, roll-in showers, ceiling lifts, and modified vans. It also includes medical equipment that must be replaced on a schedule. It is not bought just once.

To project these costs, catastrophic-injury attorneys usually work with a life care plan. A life care planner prepares this detailed report. The planner works from the recommendations of your treating doctors.

The report lists every future need. These include care hours, equipment, therapy, and medication. It also lists how often each item must be replaced.

A forensic economist then reduces those future costs to present value. This means calculating what the future costs are worth today, using accepted methods. This work is careful and detailed. It is the opposite of a one-click estimate.

Non-Economic Damages: The Human Cost

Non-economic damages pay for real harm that does not appear on an invoice. They include:

Physical pain and suffering, now and in the future.

Mental and emotional distress after a sudden, life-changing injury.

Loss of enjoyment of life and independence.

Loss of consortium: harm to a spouse’s or family relationship, where the law allows it.

No fixed formula measures these losses. They are proven with evidence. That evidence includes medical records and your own testimony. It also includes accounts from family, coworkers, and caregivers. These people can describe daily life before and after the injury.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

The Family’s Side: Long-Term Care Needs and Wrongful Death

Catastrophic injuries rarely affect only one person. A spouse may leave work to become a full-time caregiver. Adult children may move home or change jobs. They may also handle months of medical appointments and paperwork. Parents may spend savings they had set aside for retirement.

These are real losses. They belong in the value of the case. Recording them early helps. Keep caregiving logs, receipts, and statements from the people providing care. This is one of the most useful things a family can do.

When an injury is fatal, a wrongful-death claim is brought for the family left behind. The key question is what the loss means for the people who depended on the person who died. That includes lost financial support and lost household services. It also includes the years of care, companionship, and guidance that will not happen.

These claims get the same careful handling as any catastrophic case. Families are encouraged to ask about their own situation directly.

The Hidden Reducers Families Often Miss

Many families are surprised to learn that the number on a medical bill is not always the number that counts. Three rules can change a settlement’s value a great deal.

Letters of Protection

Some providers treat an injured person without payment up front. In return, they expect to be paid from any settlement or judgment. This arrangement is called a letter of protection.

Florida law defines it broadly. Under Fla. Stat. §768.0427, a letter of protection is “any arrangement by which a health care provider renders treatment in exchange for a promise of payment for the claimant’s medical expenses from any judgment or settlement of a personal injury or wrongful death action,” whatever it is called.

The same statute makes disclosure a requirement. Before a claimant can seek medical expenses treated under a letter of protection, the claimant must disclose a copy of that letter, all itemized and coded medical billings, the dollar amount for which any factoring company or other third party purchased the provider’s accounts (including any discount below the invoice amount), whether the claimant had health care coverage (and its identity), and whether the claimant was referred for treatment under the letter (and by whom).

The statute also defines a factoring company. This is a company that buys a health care provider’s accounts receivable (unpaid bills) at a discount below their invoice value. If a provider’s bills have been sold, that sale can affect how the bills are presented.

Amounts Actually Paid vs. Billed Charges

Under Fla. Stat. §768.0427, evidence of medical treatment that has been satisfied “is limited to evidence of the amount actually paid, regardless of the source of payment.”

So a billed amount that was never paid can be a much weaker measure than it first looks.

Keep every explanation of benefits, payment record, and provider statement.

Collateral Sources

Under Fla. Stat. §768.76, the court reduces an award by amounts paid for the claimant’s benefit from collateral sources.

There is no reduction for a collateral source that has a subrogation or reimbursement right. Subrogation means the payer can seek to be repaid from your recovery.

The reduction is also offset to the extent that the claimant, or the claimant’s immediate family, paid, contributed, or gave up something to secure the benefit. In practice, a premium your family paid for coverage can count in your favor.

Personal injury protection (PIP) is one example.

Florida’s no-fault (PIP) insurance provides a limit of $10,000 in medical and disability benefits under Fla. Stat. § 627.736. Separately, Fla. Stat. § 768.76(2)(a)2 lists, among collateral sources, “automobile accident insurance that provides health benefits or income disability coverage,” which is the language that applies to PIP benefits.

Under Fla. Stat. § 627.736, medical benefits cover eighty percent of all reasonable expenses for medically necessary medical, surgical, X-ray, dental, and rehabilitative services if the individual receives initial services and care within 14 days after the motor vehicle accident. Disability benefits are set at 60% of any loss of gross income and loss of earning capacity from inability to work proximately caused by the injury.

Whether and how these benefits affect a claim depends on the facts. Bring every benefit statement to your first conversation.

Punitive Damages and the Caps That Apply

Punitive damages punish especially serious wrongdoing. They do not pay for injuries. They are not available in every case. Whether they are available depends on the facts and the law.

Florida law governs punitive damages as follows:

In that case, the cap is the greater of four times compensatory damages or $2 million.

If the factfinder finds the defendant had a specific intent to harm the claimant, and the conduct did in fact harm the claimant, there is no cap.

So the timing of your injury matters. We will review it with you.

Key Factors That Shape Value

No single factor decides a case. The main factors are:

Severity and permanence. A complete injury (AIS A) with permanent paralysis generally carries higher lifetime costs than an incomplete one.

Liability. This is how clearly the evidence shows that another party was at fault.

Available insurance and assets. Value depends on the coverage that exists. It also depends on whether the responsible party can actually pay.

Comparative fault. Under Fla. Stat. §768.81, contributory fault “diminishes proportionately the amount awarded.” This reduces the award by the part caused by the claimant’s own fault. But it “does not bar recovery.”

However, a party found greater than 50% at fault for their own harm “may not recover any damages.” This bar does not apply to medical negligence claims under chapter 766.

Under Fla. Stat. § 768.81, a defendant who wants a nonparty included on the verdict form for apportioning damages must prove at trial, by a preponderance of the evidence, the fault of the nonparty in causing the plaintiff’s injuries. The standard is a preponderance of the evidence, meaning more likely than not.

Quality of documentation. Thorough records and credible professional witnesses support a fuller, more defensible picture of damages.

Multiple liable parties. A case may involve several defendants. For example, a negligent driver, a trucking company, and an equipment manufacturer.

After a verdict, a judge reviews the amount. Under Fla. Stat. §768.043, in personal injury or wrongful death cases arising from the operation of a motor vehicle, the court, upon proper motion, checks whether the award is “clearly excessive or inadequate” for the facts presented.

If it is, the court orders a remittitur (reducing the award) or an additur (increasing it); if the party adversely affected does not agree, the court orders a new trial on damages only. This is one more reason a well-documented damages case matters.

When the Defendant Is a Government Agency

Injuries caused by a city, county, state agency, or other public body follow different rules.

Under Fla. Stat. §768.28, neither the state nor any agency or subdivision of the state waives any defense of sovereign immunity by entering a contractual relationship with another agency or subdivision of the state. It gives up this protection for tort liability only to the extent the statute says. The state, its agencies, and its subdivisions are liable “in the same manner and to the same extent as a private individual under like circumstances.”

That liability does not include punitive damages or pre-judgment interest. The statute also caps recovery:

The state and its agencies and subdivisions are not liable to pay more than $200,000 on a claim or judgment by any one person; a judgment above that may be entered, but the excess may be paid only by further act of the Legislature.

The state is not liable to pay claims or judgments from the same incident which, when totaled with all other claims or judgments the state pays from that incident, exceed $300,000.

A judgment above these amounts may be entered. But the excess may be paid only through a further act of the Legislature.

The statute also sets procedural rules for claims against public bodies. These include information the claimant must give the agency.

Injuries involving a government defendant, such as a crash with a public vehicle or a hazard on public property, need prompt review.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

When the Injury Happened in an Airplane

Air travel is governed by an international treaty. SDRs are the special drawing rights, a unit of value the treaty uses.

The limit for death or bodily injury will increase from 128,821 SDRs to 151,880 SDRs (about US$202,500), up from 100,000 SDRs set in 2003 (ICAO). The death or bodily injury limit is set to rise from 128,821 SDRs to 151,880 SDRs, a figure given as about US$202,500 (ICAO).

ICAO’s published figures for the 2024 revision also list:

6,303 SDRs per passenger for delay in passenger transport,

1,519 SDRs per passenger for destruction, loss, damage, or delay of baggage, and

26 SDRs per kilogram for cargo.

According to ICAO, the increased figures are scheduled to take effect on 28 December 2024 (ICAO).

Airline claims often involve several countries, treaty rules, and carriers. These cases need careful, prompt review of the ticket, the itinerary, and the carrier’s conditions of carriage.

Trucks, Brokers, and Who Is Responsible

Truck crashes are a leading cause of catastrophic injury. The responsible parties can reach beyond the driver.

In Montgomery v. Caribe Transport II, LLC, 608 U.S. 219 (2026), the U.S. Supreme Court addressed a state-law claim. In Montgomery v. Caribe Transport II, LLC (May 14, 2026), the U.S. Supreme Court concluded that Montgomery’s negligent-hiring claim falls within the FAAAA’s safety exception, which saves it from preemption. The Court held that “Montgomery’s negligent-hiring claim falls within the FAAAA’s safety exception, which saves it from preemption.”

The ruling does not decide every trucking claim. It does confirm that certain state-law claims about how a carrier was selected can go forward.

Commercial carriers often hold much larger insurance policies than passenger drivers. So a truck crash can involve more coverage than a typical car accident.

How Insurance Companies Evaluate Catastrophic Claims

Insurers aim to pay as little as the facts allow. That is their business model. It helps to know this before you talk with them.

Adjusters review your medical records for weak spots. They look for gaps in treatment, a hopeful note in a chart, or a doctor’s uncertainty about prognosis. They may argue that future care will cost less than your doctors project. They may also argue that you could still hold some job despite paralysis.

Independent professional evidence can close that gap. A well-built life care plan and a vocational assessment answer the insurer’s assumptions with documented need. Without that proof, a catastrophic claim is often undervalued.

Deadlines: Filing Date vs. Accrual Date

Florida sets deadlines for filing injury claims. Missing one can end even a strong case.

Two dates matter, and people often confuse them:

The accrual date is when the claim’s clock starts.

The filing date is the last day a lawsuit can be filed.

These dates are not always the same day. Which rule applies depends on the type of claim and the defendant. Claims against government bodies, and medical negligence claims under chapter 766, have their own requirements.

Do not assume the date of the accident is the date your deadline runs from. Contact us promptly so the deadlines in your case can be reviewed.

Why an Attorney’s Work Affects Case Value

An attorney’s central job is documentation. The goal is to make sure no future loss goes unaccounted for.

Our attorneys coordinate the treating physicians, the life care planner, the economist, and the vocational assessor. Together, they build one complete record of past, present, and future damages.

This work protects clients from a common trap. An early insurance offer may look large but fall far short of lifetime cost. Our attorneys also check the hidden reducers described above before any number is accepted.

Our attorneys are licensed and admitted to The Florida Bar. The firm handles personal-injury cases of every severity throughout Florida. We offer support in English and Spanish.

We cannot promise a specific result. What we can do is explain the process, gather the evidence, and advocate for the full value the facts support.

For the bigger picture, see our main guide on catastrophic injury claims.

Frequently Asked Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Why won’t you publish an average settlement amount?

A published average would mislead you.
